The 1oth lawsuit against Apple by French activist group Halte à l’Obsolescence Programmée (HOP – Stop Planned Obsolescence). The HOP filed a criminal case against Apple Inc for slow iPhone to increase sales. If the charges stick, the lawsuit may lead to a heavy fine and possible jail.

The Halte à l’Obsolescence Programmée V/S Apple

Halte à l’Obsolescence Programmée (HOP) filed a criminal lawsuit against Apple Inc. for jeopardizing the environment. According to HOP, Apple deliberately lowered the performance of older iPhone to boost the sale and production of newer models.

According to HOP, “Apple has put in place a global strategy of programmed obsolescence in order to boost its sales”.

The lawsuit was filed with the office of Paris District Prosecutor.

The suit was filed on Wednesday in the Paris prosecutor’s office, HOP released a statement clearing their position.

According to HOP believes Apple is guilty of “deliberately reducing the lifespan of a product to increase the rate of replacement”.

Apple intentionally rolled out an update to slow iPhone in order to conserve battery life. Many believe that Apple did that to increase the sale of new iPhones.

In August 2015, France passed a law that made it criminal to design or modify a product that is targeted to increase the rate of replacement by reducing the lifespan.

It is not new for Apple to break or mend laws, previously US FCC took action against Apple.

The case against Apple is the textbook, and Apple executives may face Jail term.

It believes Apple could be liable for a fine in line with the value of all its iPhone French sales since the law came into force.

The suit will be heard in a criminal court instead of a Civil Court. If the case is accepted on the terms then it will go to trial.

According to the conservative estimate, if case tilts toward Apple, they may face a maximum penalty of 300,000 Euros, Jail Term for top executives, & 5 % of firm’s annual turnover as fine.

Apple will have to pay fine for every iPhone they sold in France from September 2015 to till now.

Class Action against Apple on Slow iPhone a.k.a #Batterygate

The 9th case against Apple is filed in the USA. The first party is Michael Hakimi.

According to the case filed by Mr Michael Hakimi in US District Court of California, Apple is accused of following charges.

Hakimi’s lists nine causes for their Class Action lawsuit, the most by any of the lawsuits to date, as follows:

01: Strict Products Liability

02: Negligence – Products Liability

03: Violation of the Consumers Legal Remedies Act (Cal. Civ. Code § 1750 et seq.)

04: Unfair Competition (Bus. and Prof. Code § 17200 et seq.)

05: Breach of Express Warranty under the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.)

06: Breach of Express Warranty

07: Breach of the Implied Warranty of Merchantability

08: Breach of Implied Warranty of Fitness for a Particular Purpose

09: Violation of California’s False Advertising Laws

10: Fraud

11: Unjust Enrichment
